Terms of Use

Apple App Store notice: These Terms of Use constitute the End User License Agreement (EULA) for Cleave on iOS. This agreement is between you and Youssef Chajia (Red Rain), not Apple Inc. Apple is not a party to this agreement and has no obligation to provide maintenance, support, warranty, or product-liability coverage for Cleave.

1. Acceptance of terms

By downloading, installing, or using the Cleave mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms apply to all users worldwide.

These Terms were last updated on June 20, 2026. We may revise them from time to time; continued use of the App after changes are posted constitutes acceptance.

2. Licence

Subject to your compliance with these Terms, Youssef Chajia (Red Rain) grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices that you own or control, solely for your personal, non-commercial entertainment. The App is licensed, not sold.

You may not: (a) copy, modify, or create derivative works of the App; (b) reverse-engineer, decompile, or disassemble the App (except as expressly permitted by applicable law); (c) rent, lease, loan, sell, sublicense, or distribute the App; (d) remove or obscure any proprietary notices.

3. Eligibility

You must be at least 13 years old (or the applicable minimum age in your country) to use the App. By using the App you represent that you meet this requirement. The App is not intended for use by children under 13.

4. In-app purchases and billing

Cleave offers a single optional in-app purchase: "Remove Ads" — a one-time payment of USD $4.99 (or equivalent in your local currency) that permanently removes all advertisements from the App.

All payments are processed by Apple (iOS) or Google Play (Android). You agree to Apple's or Google's payment terms at the time of purchase.
Purchases are non-refundable unless required by applicable law or the applicable platform's refund policy. Refund requests must be directed to Apple via reportaproblem.apple.com or to Google Play support.
The "Remove Ads" entitlement is tied to your App Store / Google Play account and can be restored on any device signed into that account via the in-app "Restore Purchases" function.
We reserve the right to change pricing or available purchases with reasonable notice.

5. Acceptable use

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable regulations;
Attempt to gain unauthorised access to the App's backend services or data;
Reverse-engineer the scoring algorithm or submit fraudulent puzzle solutions;
Interfere with or disrupt the integrity of the App or related servers;
Use automated scripts to interact with the App.

6. Intellectual property

All content, visual elements, puzzle shapes, scoring logic, graphics, sound assets, and trademarks in the App are the exclusive property of Youssef Chajia (Red Rain) or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in the App or its content.

The font "Inter" is used under the SIL Open Font Licence 1.1. Other open-source components are used under their respective licences.

7. Third-party services and advertisements

The App integrates third-party services including Google AdMob, RevenueCat, Supabase, PostHog, and Apple/Google platform services. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the content of third-party advertisements or the practices of third-party service providers.

You acknowledge that Apple Inc. is a third-party beneficiary of these Terms solely to the extent of any provisions that apply to the iOS App Store distribution; Apple may enforce those provisions directly against you.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Daily puzzles may occasionally be unavailable due to maintenance.

IN THE EVENT OF ANY FAILURE OF THE APP TO CONFORM TO AN APPLICABLE WARRANTY (TO THE EXTENT SUCH A WARRANTY CANNOT BE DISCLAIMED), THE SOLE REMEDY WILL BE A REFUND OF ANY APPLICABLE PURCHASE PRICE; APPLE AND GOOGLE HAVE NO OTHER WARRANTY OBLIGATION WITH RESPECT TO THE APP.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL YOUSSEF CHAJIA (RED RAIN) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE IN-APP PURCHASE THAT DIRECTLY GIVES RISE TO THE CLAIM, OR (B) €50.

10. Maintenance and support

We are responsible for providing maintenance and support for the App as required by applicable law and as described in our Support page. Apple and Google have no obligation to furnish any maintenance or support services with respect to the App.

11. Product claims

We are responsible for addressing any claims you (or any third party) may have relating to the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation. Apple and Google are not responsible for such claims.

12. Export and sanctions compliance

You represent that you are not located in a country subject to an applicable government embargo or sanctions regime, and that you are not on any government list of prohibited or restricted parties.

13. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any provision. Upon termination, you must cease all use of the App and delete it from your devices. Sections 6, 8, 9, 11, and 14 survive termination.

14. Governing law and disputes

These Terms and any dispute arising from them are governed by and construed in accordance with the laws of Hungary, without regard to conflict-of-law principles. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Budapest, Hungary.

If you are a consumer resident in the European Union, you may also have access to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to these terms

We may modify these Terms at any time. We will post the revised Terms with an updated date and, where the changes are material, provide notice within the App. Your continued use of the App after such notice constitutes acceptance of the updated Terms.

16. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Youssef Chajia (Red Rain) with respect to the App and supersede all prior agreements and understandings. If any provision is found unenforceable, the remaining provisions remain in full effect.
